Parties & Acceptance
GalleryZone is operated by Galleryzone Private Limited ("GalleryZone," "we," "us," or "the Company"). These Terms of Service govern every artist, aggregator, and customer account on the platform, alongside any separate signed agreement (such as an artist or aggregator Memorandum of Understanding) that sets out additional role-specific terms.
By creating an account, you agree to these Terms. If you don't agree, please don't use GalleryZone.
Accounts
You must register an account to list, reserve, or purchase artwork on GalleryZone. You agree to provide accurate registration information and to keep it up to date, and you're responsible for all activity that happens under your account.
Artists additionally submit government ID and, where applicable, a signature sample as part of onboarding; this is used to verify identity and to support the Certificate of Authenticity issued for each listed artwork, and is not shared publicly.
Artwork Eligibility
Every artwork submitted for listing must be 100% handmade and created by the submitting artist. Replicas, AI-generated or AI-assisted pieces, digital prints, machine-generated reproductions, NFTs, and copied artwork are not eligible for listing unless expressly approved in writing by GalleryZone.
The artist must be the sole owner of the artwork, and the artwork must not infringe any third party's copyright, trademark, or other intellectual property rights. GalleryZone's curator review checks quality, authenticity, and eligibility before a listing goes live, and reserves the right to reject any artwork, or request corrections, at any stage of that review without being required to give a reason.
Once an artwork has been listed, the artist agrees not to create or list a replica of that same piece elsewhere; doing so undermines the work's value and may result in termination of the artist's account or delisting of the affected artwork.
Artwork Submission Requirements
Before an artwork can be shipped for display or fulfillment, the artist must provide complete artwork details, including the artwork's name, dimensions, medium, subject, type, year of creation, and a written description; high-quality photographs; an artist profile; a completed Certificate of Authenticity; a government-issued ID; a signature sample; and any additional information GalleryZone reasonably requests.
Digital Identity & Provenance
On approval, every artwork receives a unique GalleryZone digital identity. GalleryZone may generate a digital certificate of authenticity, ownership and provenance records, and QR/NFC verification tags linked to that identity, and may retain digital copies of these records permanently.
Artwork images and details may be used by GalleryZone for marketing, exhibitions, publications, social media, and other promotional activities connected with the platform.
Artist Verification
Artists are encouraged, though not required, to link official social media profiles (Instagram, Facebook, YouTube, X, TikTok) showing studio work, the creation process, or work in progress. A verified social presence is one of the signals used toward the Gold ✦ Verified badge described on our About page, and helps build collector confidence in a listing.
Pricing Confidentiality
The artist's listed price for a work is private and is never shown to buyers or the public. Only the final customer-facing price (which includes GalleryZone's markup and applicable GST) is displayed. This confidentiality is enforced at the platform level, not just hidden by the interface.
Artists must not publicly disclose an artwork's listed price through any channel, including social media, personal or third-party websites, videos, interviews, exhibitions, promotional materials, or public comments. Violating this may result in removal of the affected artwork and termination of the artist's account.
GalleryZone reserves the right to reject or delist an artwork at any stage, including after it has gone live, if it's found to no longer meet eligibility or quality standards.
Listing Terms
Listing artwork on GalleryZone is free; there is no confirmation fee for listing a piece.
The artist retains full ownership of an artwork until a sale is confirmed and delivered. Listing a work does not transfer ownership, and grants GalleryZone only a non-exclusive, worldwide licence to photograph, publish, advertise, exhibit, and promote the artwork for as long as the listing remains active.
While a listing is active, the artwork may not simultaneously be listed for sale on another marketplace or platform. If an artwork has been selected by an authorized aggregator for physical display, it will not be removed from the GalleryZone marketplace until GalleryZone approves the removal or the listing period expires.
An artwork remains listed for up to six (6) months. If it hasn't sold in that time, GalleryZone will coordinate its return; any agreed return-shipment charges will be communicated to the artist in advance.
Aggregator Role & Inventory
An aggregator is an authorized display and sales-support partner, not the owner of the artworks it displays. Aggregators must display artwork professionally, protect it from damage, and may not sell it independently, transfer ownership, or alter its price without GalleryZone's written approval. Ownership of a piece transfers only after full customer payment and confirmed delivery.
GalleryZone may place inventory at an aggregator's premises for display, and an aggregator may also place orders directly through the GalleryZone platform. Artwork placed for display remains with the aggregator for up to thirty (30) days unless GalleryZone approves a longer period, and must be returned on request. Aggregators must keep inventory safe, report any damage immediately, permit GalleryZone to audit inventory on request, and return it when asked.
Before taking possession of artwork for display, an aggregator pays a security deposit of 5% of the artwork's value plus applicable delivery charges. This deposit is adjusted against the aggregator's earnings on a successful sale.
Aggregator Pricing & Earnings
All customer orders are processed exclusively through GalleryZone, which issues invoices, collects payment, coordinates logistics, and manages customer communication. Pricing is set solely by GalleryZone; an aggregator gets one opportunity to confirm the listed selling price at checkout through the GalleryZone portal, and may not apply unauthorized discounts or change prices independently.
An aggregator earns 20% of the difference between the artist's price and the GalleryZone/aggregator listed price for that piece (profit share = 20% × (Listed Price − Artist Price)). Any additional commission is at GalleryZone's sole discretion. Payment becomes due only after full customer payment, confirmed delivery, and the end of any applicable return or cancellation period.
Aggregators do not issue independent warranties on artwork they display; GalleryZone is responsible for ensuring genuine sourcing.
Shipping, Insurance & Packaging
Transit insurance is mandatory for shipments and strongly recommended for any artwork valued above ₹20,000, arranged through GalleryZone's partner, HDFC ERGO. If an artist voluntarily declines transit insurance, the artist bears sole responsibility for theft, fire, transit damage, loss, wear and tear, natural disasters, and other unforeseen incidents during transit; GalleryZone, its employees, aggregators, and logistics partners are not liable for loss or damage where insurance has been declined. Insurance charges, where opted into, are borne by the artist.
For display through an authorized aggregator, artwork must be supplied either professionally stretched on canvas or properly framed, with hangers provided, and packaged to GalleryZone's shipping standards; GalleryZone may reject improperly packaged artwork.
A one-time transportation charge for delivering the artwork to its assigned aggregator is deducted from the artist's settlement after a successful sale. Delivery charges for a customer's order are payable separately by the customer.
Certificate of Authenticity
Artists complete the Certificate of Authenticity (COA) for each artwork through the GalleryZone platform before shipment; GalleryZone may retain digital copies of the COA permanently. If a customer requests a physical COA after purchase, the artist is responsible for printing, signing, and dispatching it through GalleryZone.
Payments & Settlement
After a confirmed sale, the artist receives their confidential listed price, less applicable deductions: GST and other taxes, shipment and delivery charges, insurance charges (where opted into), convenience charges, and any other charges agreed in advance. Settlement is normally processed within 7 days of successful delivery and receipt of payment from the customer, paid directly to the artist's bank account on file.
Aggregators earn a share of the markup on artworks they've reserved and sold through their own channel, settled once a recorded sale is confirmed, subject to the security-deposit adjustment described above. Withdrawal requests are processed against the balance available in your GalleryZone wallet; minimums and processing timelines are shown in-app at the time of withdrawal.
Confidentiality
GalleryZone and its aggregator partners agree to keep each other's non-public business information confidential.
Intellectual Property
All GalleryZone intellectual property, including its platform, brand, and technology, remains the exclusive property of Galleryzone Private Limited.
Limitation of Liability
GalleryZone facilitates listing, discovery, payment, and logistics for original artwork, but does not guarantee that any given artwork will sell, or set a floor on how quickly it will. GalleryZone is not liable for failure to sell an artwork, ordinary market fluctuations in demand, or indirect or consequential damages arising from use of the platform. To the fullest extent permitted by law, GalleryZone's liability for any claim arising from your use of GalleryZone is limited to the fees actually paid to GalleryZone in connection with that claim.
Where transit insurance has not been opted into for a physical shipment, GalleryZone is not liable for loss or damage occurring in transit.
Termination
GalleryZone may suspend or terminate an account, and remove any associated listings, for counterfeit or non-original work, materially false information provided during onboarding or listing, a breach of pricing confidentiality, intellectual property infringement, unauthorized sale of consigned inventory, negligence in the care of consigned artwork, misuse of GalleryZone property, or fraud.
Aggregator agreements run for one year from their effective date and renew automatically unless either party gives 30 days' written notice of termination.
Force Majeure
Neither GalleryZone nor an aggregator is liable for delays or failures to perform caused by events beyond that party's reasonable control.
Dispute Resolution
Most disagreements, over a delivery, a sale record, or a settlement, are resolved directly through GalleryZone support in the first instance. If a dispute involving an aggregator can't be resolved that way, it will be referred to arbitration in Hyderabad under the Arbitration and Conciliation Act, 1996.
Governing Law
These Terms are governed by the laws of India. The courts of Hyderabad, Telangana have exclusive jurisdiction over any dispute arising out of or relating to your use of GalleryZone.
Changes to These Terms
Amendments to these Terms are made in writing. When they take effect, this page is updated with the revised text and a new "Last updated" date; continued use of GalleryZone after that date constitutes acceptance of the revised Terms.
